1.1 Identification of the Provider

The website OpenAcademia (hereinafter the Site) is owned and operated by OpenCom Impresa Sociale Società Cooperativa (hereinafter OpenCom or the Provider), with registered office at Piazza Giotto n. 13, 52100 Arezzo (AR), Italy.

1.2 Definitions

For the purposes of these Terms of Service, the following definitions apply:

User

any individual or legal entity accessing or using the Site.

Course

any educational resource, module, or programme hosted on or linked to through the Site.

EU-Funded Content

any course, material, or resource developed within the framework of a project co-funded by the European Union, including but not limited to Erasmus+, Horizon, or other EU programmes.

External Platform

any third-party website or learning management system to which the Site links or redirects Users, including platforms operated by OpenCom (e.g. projectmanager.academy) or by trusted partners.

Partner

any organisation that has collaborated with OpenCom in the delivery of EU-funded projects.

1.3 Acceptance of Terms

By accessing or using the Site, Users accept these Terms of Service in full. Users who do not accept these terms must discontinue use of the Site immediately. OpenCom reserves the right to update these Terms at any time; continued use of the Site following any update constitutes acceptance of the revised Terms.

2.1 Purpose of the Site

OpenAcademia is an educational portal providing access to courses and learning resources in the fields of project management, digital skills, and related subjects. The Site operates as an aggregation and access point for:

• Courses developed by OpenCom as part of EU-funded projects.
• Courses hosted on external platforms operated by OpenCom (e.g. projectmanager.academy).
• Courses hosted on platforms operated by trusted partner organisations.
• Links and references to publicly accessible educational resources from verified third-party providers.

2.2 Free and Paid Content

Some courses and resources available through the Site are offered free of charge, particularly those developed as outputs of EU-funded projects where open access is required. Other courses, particularly those leading to professional certifications, may be subject to a fee. Users will be clearly informed of any costs before accessing paid content.

2.3 EU-Funded Courses – Special Notice

European Union Co-Funding Notice

A significant portion of the content available on or through this Site has been developed within the framework of projects co-funded by the European Union. OpenCom does not claim ownership of EU-funded content where intellectual property rights vest in the project consortium, individual authors, or the European Union. The European Commission’s support does not constitute an endorsement of the content or of OpenCom.

3.1 OpenCom Content

Content created solely by OpenCom — including website design, text, graphics, and original course materials — is the intellectual property of OpenCom and is protected by applicable copyright law. Reproduction, distribution, or modification without prior written authorisation from OpenCom is prohibited.

3.2 EU-Funded Content

Courses and materials developed under EU-funded projects are subject to the intellectual property provisions of the applicable project agreements. Such content is typically made available under open licences (e.g. Creative Commons). The applicable licence terms are indicated within each course or resource where relevant.

3.3 Third-Party and Partner Content

Content hosted on or linked from external platforms remains the intellectual property of the respective owners. OpenCom makes no claim over such content and accepts no liability for its accuracy, availability, or continued accessibility.

3.4 Trademarks

Any trademarks, certification marks, or brand names referenced on the Site (such as PRINCE2®, PeopleCert, Erasmus+, or partner organisation names) are the property of their respective owners and are used solely for identification and informational purposes.

4.1 Links to External Platforms

The Site contains links to external platforms, including OpenCom-operated platforms (e.g. projectmanager.academy), platforms operated by partner organisations, and publicly available third-party educational platforms.

4.2 Responsibility for External Content

OpenCom does not control the content, policies, or availability of external platforms. Once a User navigates away from OpenAcademia to an external platform, they are subject to the terms, conditions, and privacy policies of that platform. OpenCom accepts no liability for content hosted on external platforms.

5A.1 Account Creation

Access to certain courses and resources on the Site requires the creation of a personal user account. Users must provide accurate, complete, and up-to-date information, including a valid email address. Users must be at least 16 years of age to register an account.

5A.2 Account Credentials

Users are solely responsible for maintaining the confidentiality of their login credentials. Users must not share their credentials with any third party.

5A.3 Account Types

The Site offers different levels of account access:

Guest / Free

open-access courses and EU-funded content available without charge.

Registered Learner

broader course catalogue, progress tracking, and course completion records.

Institutional

for organisations, schools, or project partners operating under a specific agreement with OpenCom.

5A.4 Course Enrolment, Progress, and Certificates

Where issued, completion certificates or digital badges are personal to the registered User and may not be transferred. Unless otherwise stated, certificates issued through OpenAcademia are informational and non-accredited and do not in themselves confer professional qualifications.

5A.5 Single Sign-On and External Platform Access

Where the Site uses SSO or redirects Users to an external platform, data necessary to enable access may be shared with that platform. The external platform’s own terms of service and privacy policy will apply.

5A.6 Account Suspension and Termination

OpenCom reserves the right to suspend or permanently terminate a User’s account in the event of breach of these Terms, provision of false information, or harmful conduct. Users may request deletion of their account at any time by writing to info@opencom-italy.org.

6.1 Accuracy of Information

OpenCom makes reasonable efforts to ensure that information on the Site is accurate and up to date. However, OpenCom cannot guarantee the completeness or currency of all content and accepts no liability for errors or omissions.

6.2 Availability of the Site

OpenCom does not warrant that the Site will be available at all times without interruption. Scheduled maintenance, technical issues, or circumstances beyond OpenCom’s control may result in temporary unavailability.

6.3 EU-Funded Content Disclaimer

🇪🇺 The views expressed in EU-funded course content are those of the authors and do not necessarily reflect the official position of the European Union or its institutions. Neither OpenCom nor the European Commission can be held responsible for any use made of the content.

6.4 Limitation of Liability

To the maximum extent permitted by applicable law, OpenCom’s liability to any User shall be limited to direct damages actually proven. OpenCom shall not be liable for indirect, consequential, or incidental damages.

9.1 Amendments

OpenCom reserves the right to amend these Terms of Service at any time. Amendments will take effect upon publication on the Site. Registered Users will be notified of material changes via the email address associated with their account.

9.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.3 Language

These Terms of Service are drawn up in Italian and English. In the event of any discrepancy, the Italian text shall prevail for users resident in Italy; the English text shall prevail in all other cases.
